Welcome to Petify AI. These Terms of Service ("Terms") constitute a legally binding agreement between you and Petify AI ("we," "us," or "our") governing your use of the Petify AI mobile application (the "App"), including any content, functionality, and services offered through the App.

By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the App.

Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you are at least 13 years old and that your use of the App does not violate any applicable laws or regulations.

Account Responsibility

You are solely responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

User Content

Content Ownership

When you upload photos to our App for meme generation, you retain ownership of your original photos. However, you grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, store, modify, and display your content for the purpose of providing and promoting our services.

Content Restrictions

You agree not to upload content that:

• Infringes on any intellectual property rights.
• Depicts individuals without their consent.
• Contains sexually explicit, violent, or offensive material.
• Violates any applicable laws or regulations.
• Contains malware, viruses, or other harmful code.

Monitoring and Removal

We reserve the right, but not the obligation, to monitor and review content uploaded to the App. We may remove any content that violates these Terms or that we find objectionable for any reason.

Subscription and Payment Terms

Petify PRO Weekly Subscription

We offer a premium subscription service ("Petify PRO Weekly Subscription") that provides additional features, including unlimited meme generation.

Payment Processing

All payments and subscriptions are processed through Apple Pay. Your use of Apple Pay is subject to Apple“s terms and conditions.

Subscription Terms

• Subscription fees will be charged at the beginning of your subscription and upon each renewal.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• You can manage your subscription, including cancellation and renewal options, through your Apple ID account settings.
• No refunds will be issued for partial subscription periods.

Intellectual Property

App Content

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, and the design, selection, and arrangement thereof) are owned by Petify AI or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Trademarks

The Petify AI name and logo are trademarks of Petify AI. You must not use such marks without our prior written permission.

AI-Generated Content

Memes generated through our App using AI technology are provided for your personal use. While you may share these memes on social media or with friends, you may not use them for commercial purposes without our express permission.

Prohibited Uses

You agree not to use the App:

• In any way that violates any applicable law or regulation.
• To impersonate or attempt to impersonate any person or entity.
• To engage in any activity that interferes with or disrupts the App“s functionality.
• To attempt to gain unauthorized access to the App or related systems.
• To use automated methods or bots to access or use the App.
• To reverse engineer or attempt to extract the source code of the App.

Disclaimers

As-Is Service

The App is provided on an "as-is" and "as available" basis, without warranties of any kind, either express or implied.

AI Technology Limitations

Our meme generation uses AI technology which may not always produce perfect or expected results. We do not guarantee the quality, accuracy, or appropriateness of AI-generated content.

Limitation of Liability

To the maximum extent permitted by law, Petify AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App.
• Any unauthorized access to or use of our servers or personal information.
• Any interruption or cessation of transmission to or from the App.
• The content or conduct of any third party on the App.

Indemnification

You agree to defend, indemnify, and hold harmless Petify AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys‘ fees) arising out of or relating to your violation of these Terms or your use of the App.

Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on the App and updating the "Last Updated" date. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

Governing Law

These Terms and your use of the App shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the American Arbitration Association‘s rules. The arbitration shall be conducted in English and shall take place in the United States.

Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Petify AI regarding your use of the App and supersede all prior agreements and understandings.
